Welcome to Abbs. These Terms of Service ("Terms") govern your use of the Abbs mobile application (the "App") operated by Deep Connect Solutions ("we", "us", "our"). By creating an account or using the App, you agree to be bound by these Terms.

Please read these Terms carefully before using Abbs.

1. Eligibility

1.1 You must be at least 18 years of age to create an account and use Abbs. By using the App, you represent and warrant that you are at least 18 years old.

1.2 You must have the legal capacity to enter into a binding agreement. If you are using the App on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

1.3 You may not use the App if you have been previously banned or had your account terminated by us.

2. Account Creation and Security

2.1 You may create an account using Apple Sign-In. You are responsible for maintaining the security of your Apple ID and any credentials associated with your Abbs account.

2.2 You may optionally verify your phone number for additional account security.

2.3 You agree to provide accurate, current, and complete information in your profile. Misrepresenting your age, identity, or using someone else's photos is prohibited.

2.4 You are responsible for all activity that occurs under your account. Notify us immediately if you suspect unauthorised access.

2.5 You may only maintain one active account at a time.

3. Acceptable Use

3.1 You agree to use Abbs in accordance with all applicable laws and these Terms. You will not:

a) Post, upload, or share content that is illegal, defamatory, threatening, harassing, abusive, hateful, or that promotes violence or discrimination.
b) Upload content depicting minors or any form of child exploitation. Such content will be reported to the relevant authorities.
c) Impersonate another person or misrepresent your affiliation with any person or entity.
d) Use the App for commercial purposes, advertising, or solicitation without our prior written consent.
e) Harass, stalk, intimidate, or threaten other users.
f) Send spam, unsolicited messages, or chain messages.
g) Attempt to extract data from the App through scraping, crawling, or automated means.
h) Reverse-engineer, decompile, or disassemble the App or its backend systems.
i) Interfere with or disrupt the App's infrastructure, servers, or networks.
j) Create accounts using automated means or bots.
k) Use the App to facilitate any illegal activity, including but not limited to prostitution, drug trafficking, or fraud.
l) Share another user's private content (photos, messages, or personal information) outside the App without their explicit consent.

3.2 We reserve the right to remove content and suspend or terminate accounts that violate these Terms, at our sole discretion and without prior notice.

4. Content and Intellectual Property

4.1 Your Content

You retain ownership of the content you upload to Abbs (photos, videos, text). By uploading content, you grant us a non-exclusive, worldwide, royalty-free licence to use, display, reproduce, and distribute your content solely for the purpose of operating and providing the App. This licence ends when you delete your content or account, except where your content has been shared with other users (e.g., in chat messages) and they have not deleted it.

4.2 Content Moderation

We use automated systems and manual review to moderate uploaded content. Content that violates our guidelines may be removed, and your account may be suspended or terminated. You acknowledge that moderation decisions are at our sole discretion.

4.3 Our Intellectual Property

The App, including its design, code, features, logos, and trademarks, is owned by Deep Connect Solutions and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our prior written consent.

5. Premium Subscriptions

5.1 Subscription Tiers

Abbs offers optional premium subscription tiers:

• Gold: Enhanced features including extended discovery range and additional profile insights.
• Platin: All Gold features plus unlimited discovery range, priority visibility, and exclusive features.

5.2 Pricing and Billing

• Subscription prices are displayed in the App and are subject to change. Current pricing is available at the time of purchase through the Apple App Store.
• Subscriptions are billed through your Apple ID account.
• Payment is charged at confirmation of purchase.

5.3 Auto-Renewal

• Subscriptions automatically renew at the end of each billing period (monthly or yearly) unless cancelled at least 24 hours before the end of the current period.
• Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.
• You can manage and cancel your subscription in your Apple ID account settings or through the App Store.

5.4 Refunds

Refund requests are handled by Apple in accordance with their App Store refund policies. We do not process refunds directly.

5.5 Free Trial

If a free trial is offered, it will automatically convert to a paid subscription at the end of the trial period unless cancelled beforehand.

6. Location Services

6.1 Abbs uses your device's GPS to determine your location. This is essential for showing you nearby users and displaying approximate distances.

6.2 Your location is shared with other users only as an approximate distance (e.g., "3 km away"), not as exact coordinates, unless you choose to share your city in your profile.

6.3 You can revoke location permissions through your device settings, but this will prevent the App from functioning as intended.

6.4 In addition to your current location, the App stores a history of your location updates for up to 90 days. This location history is used to provide features such as showing where you have recently been and to improve the service. After 90 days, location history entries are automatically and permanently deleted. For further details, see our Privacy Policy.

7. Privacy

Your privacy is important to us. Our Privacy Policy, which is incorporated into these Terms by reference, explains how we collect, use, and protect your personal data. By using Abbs, you agree to our Privacy Policy.

8. Blocking and Reporting

8.1 You can block other users to prevent them from seeing your profile, contacting you, or appearing in your discovery feed. Blocking is mutual and immediate.

8.2 You can report users who violate these Terms or engage in harmful behaviour. Reports are reviewed by our moderation team.

8.3 We take reports seriously and may take action including warnings, temporary suspensions, or permanent bans based on the severity of the violation.

9. Disclaimers

9.1 The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9.2 We do not guarantee that the App will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

9.3 We do not conduct criminal background checks on users and cannot guarantee the identity, intentions, or behaviour of other users. You are solely responsible for your interactions with other users.

9.4 We are not responsible for any content posted by users. User-generated content does not reflect our views or opinions.

10. Limitation of Liability

10.1 To the maximum extent permitted by applicable law, Deep Connect Solutions and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or related to your use of the App.

10.2 Our total aggregate liability for any claims arising from your use of the App shall not exceed the amount you paid to us in the twelve (12) months preceding the event giving rise to the claim, or fifty euros (EUR 50), whichever is greater.

10.3 Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Deep Connect Solutions and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the App; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you upload or share through the App.

12. Termination

12.1 You may delete your account at any time through the App (Settings > Account > Delete Account). Account deletion initiates a 30-day soft-delete period, after which your data is permanently removed.

12.2 We may suspend or terminate your account at any time, with or without cause, and with or without notice, if we believe you have violated these Terms or engaged in conduct that is harmful to other users or to us.

12.3 Upon termination, your right to use the App ceases immediately. Sections that by their nature should survive termination (including but not limited to Sections 4, 9, 10, 11, and 14) will survive.

13. Changes to These Terms

We may modify these Terms at any time. When we make material changes, we will notify you through the App (for example, by requiring re-acceptance) and update the "Last Updated" date. Your continued use of the App after changes constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the App and delete your account.

14. Governing Law and Dispute Resolution

14.1 These Terms are governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions.

14.2 For EU consumers, mandatory consumer protection laws of your country of residence apply to the extent they provide greater protection.

14.3 Any disputes arising from these Terms or your use of the App shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the competent courts of Bremen, Germany, subject to mandatory consumer jurisdiction rules.

14.4 The European Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr. We are not obligated and not willing to participate in dispute resolution proceedings before a consumer arbitration board.

15. Miscellaneous

15.1 Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of the App.

15.2 Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

15.3 Waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

15.4 Assignment: You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
